Today the House passed a bill purported to help small business (HR 5486) that includes a provision limiting the use of grantor retained annuity trusts (GRATs). As you may remember, should the bill be considered on the Senate side, Senator Jon Kyl (R-AZ) has suggested he may offer an amendment to implement a version of the Lincoln/Kyl estate tax relief proposal. However, there is neither a timetable nor a clear path forward for the bill in the Senate, which remains bogged down in consideration of a controversial tax extender/Medicare measure.
